::URGENT!!!:: What to do if Affiliate Program Dosent properly pay your Commisions?

Hello. I signed up with an affiliate program (I would like to leave unspecified for now), and am due Sept 1st (today) my commisions. Where the Website owner is located is on the westcoast in the US, so its about 4:20pm there right now. I have yet to receive my commision payout via paypal. I emailed them yesterday to ask when I could expect payment, havent received a response yet. And I called them earlier today, voicemail picked up, left message to call back, no call back yet.
I am still to this very minute receiving new commission from new sales for my account with this webmaster.
I even did some research on this person and saw where they are refered to as an "internet marketing guru", in an interview, and they have all of there personal information online. (perhaps this lends them some credibility)...
My question is, when is the time to start worrying and take some action? If I do not receive my commisions by Sept 2nd at 12:10am (their time), what should I do? How soon without hearing from them should I possibly consult a lawyer and look to a lawsuit etc?
I dont want to panic, but I am starting to get a little worried. Thanks for your input.

I have already done that  ... Didnt find anything.. The only thing I found was this particular merchant doing interviews where the interview calls them a "marketing guru" etc...
I mean, I really dont believe someone would risk getting sued? Or maybe I dont know... I mean, I have emails for every single commission, the merchant even once emailed me a month ago and thanked me for all of the business I was bringing to them.
I'd rather not mention how much I'm owed but it's a nice amount, definitely worth suing over.

I've been ripped off also $400+ from a conmen.
Now, I don't go for personal affiliate programs, except if the man is wellknown and respected.
I prefr large affiliate networks.
Anyway, do your research before.
I asked what to do when it happened to me, but there is no mush thing you can do.
Or perhaps ask directly to Allan Gardayne at his forum: Associateprograms.
He is one of the best affiliate out there, and very honest.

Man, why rush it so much? Give it a week at LEAST. They may be having problems over paypal etc. It sounds like you need the money BADLY, forget to pay the kids school fees?
If you're relying on affiliate money to pay for essentials, you've got a problem.

I honestly think its a ****ed up day in America when someone is criticized for being upset because they were not payed money, GULP, they were actually owed, ON TIME... Perhaps my mind works a bit different than many ppl, but if you say you are going to pay, pay, what else is there to it? You've already held my money for a month, you were able to spend the money immediately when you received the sale I referred you, and go spend it on whatever you want, but I cant get my money (45 days after I generated it) when I'm DUE IT? If I get criticized for being upset, again, a ****ed up day in America, IMHO.
The sum of money owed is significant. It dosent matter if what I need the money for is "essentials" or a deck of cards, I earned it, it should be paid when they say it should be paid. What's the difference between needing the money for a liver transplant or new shoes? Rofl...
I just actually MADE PLANS with the money (when a sum of money is being accumulated for 45 days, you tend to make plans on it), not saying I NEED the money or I'm going to die.
And to me there is no difference.
but again, thanks for your input.

You should read the terms and agreements before signing up. Merchants have to play on the safe side in case there is a chargeback, refund, etc. And, of course each merchant has different policies, unless they are on an affiliate network.
I would say don't count the time. If it is a privately run affiliate program, it could be that the owner forget about it. Or, s/he was in holiday or something. It happens to all of us. And that's the risk of running an online business. Don't get too hard on yourself and force it to the world.
Just take action as necessary. Give a week or two. Give a call if that makes you better. Remember that the forum members are trying to help and volunteer their time with what they think appropriate.

This is true, I apologize to anyone if I seemed to be in a pissy mood. The Merchant did contact me back and say they are mailing the payments this month... Who cares, I mean, I'll see in 10 days or say if it actually comes. Just very very unprofessional. If you say on your site you are paying by paypal, the pay by paypal, or at least notify someone that you are no longer paying by paypal. This seems fishy to me anyway as they say they mailed the checks last month and this month due to paypal problems, but has not updated it's website in a month to let new affiliate sign ups know checks are the only method of payment?
this means 1 of 2 teams.
I've been hit with the stall-a-dope (have me wait 2 weeks for a check they never mailed)...
Or just a very very sloppy and unprofessional merchant that I wont be promoting any longer after I'm paid my due commissions...
Only time will tell. I will keep you all posted.

People paypal is a rip-off. They are freezing people's account for least little thing. I had my account frozen because I forgot to make it a Business Account. Beware of Paypal. Im hearing other stories from other marketers.
