All I know is you can be liable with this copy content and put you on hot seat, I don't know in your country (India), I work as part time blogger, and I am always careful on my writing, that's why I download a software for me to check if there's similar content on my writing(to be sure).
Imposing copyright law is almost impossible over the internet. Every country has its own set of laws, and even if your content is stolen in a place that has strong intellectual property and copyright laws, enforcement can be a hopeless cause.
The laws exist in the books, but in terms of implementation, that is another matter altogether.
If it is just an insignificant blogger, going to law against him would be silly.
You threaten his webhost instead. Webhosts are very scared of being sued, and they won't care about pulling the plug on the site of an insignificant blogger. (He can't sue his webhost; their small-print protects them.)
