Why do you need two backgrounds?
at first glance:
Header element position:relative with repeating background
The logo image could be in a element absolutely positioned and sized to fit the image, transparent backgrounds
the tabs can have a transparent background, positioned: absolute to the bottom of the header and at the top of the stacking order.
