Short answer is you can assign rights in a will to assets that are not owned but leased, licensed, etc. Domain names are no different. You don't own a domain name, but you do have the rights to it as long as you continue to register it and pay for it. Therefore a will could very easily assign rights to a domain name or a whole slew of them, and it is up to the individual who acquires those rights to preserve them aka renew registration.
