Of course it is.
What is important here is the fact that there is music invloved.
contained in a swf, or in a mp3 is just a subtle difference that won't affect much the enterprises who are looking for infringments, as long as the music can be heard / downloaded.
And remember, everything you can see or hear on your computer CAN be downloaded, in one way or another....
