If I were to get a freelance designer to code me a custom script, who's to stop them from selling it to someone else? Half the time I would post a project on GetAFreelancer, I would have freelancers offer me a website that they CLAIM came from a client who never paid them.

In a word..."nothing".

A freelancer is only bound by his/her own ethics as it pertains to code and websites. Even non-competition agreements don't hold any water legally iin some jurisdictions.

The only thing I can suggest is that you do your homework, see if the freelancers are working on multiple competitive sites (more than one site for a competitor within the same industry), find out their reputation in the industry, etc.

I am a freelancer for two years. I live in Ukraine. I worked with getafreelancer.com and had some clients from there and some clients from Russian speaking sites. I know many other freelancers in my area (PHP development). And the most important things in negotiation are understanding and trust.

It is very ofter client do not keep his agreement and do not pay full price or re-sell scripts. Also freelancers may not complete the work in time, or ask more money. There are some advises how to defend yourself form trick.
  1. I do not agree that you need to hire only freelancers with a great experience. Some young guys are very skilled and they work quickly and effectively. Because they do not have a big portfolio, they work cheaper and sometimes even for feedback.
  2. If you try to work with freelancer choose one who is a professional in his area. I mean do not work with guys who do everything. Thay know a lot but a little bit. If you need a forum, find a guy who made 10 forums or made few but very good.
  3. Always ask for works from the past. And of course every freelancer has to have a site to show the result. It is not necesarry must be a very big or well done site, but he/she has to be able to show a work online.
  4. Always better to communicate through email. It has form of documents and you always have a copy. All the tasks and agreements must be saved and read.
  5. Big projects better to give to a team of freelancers. It's so risky to give project for 2000$ to one guy. If he will get sick or his computer will die you work will nod be made.
  6. Good freelncers always communicate. I always tell to my client stages of work. Even small parts, but I work and show it to the client.
  7. Prices for the work is a very huge and uncertan topic. If you hire a freelancer who promices to write you a CMS for only 20$, probably will make pure product for you or just will take some others CMS and adjust it for you. The problem of prices that you need to propose before work is started. Good thinking is to pay for each part of the project.
As a freelancer I also want to tell, that the task of work is highly important. Please write more clear about your needs and how the script must work, where and what are the goals. It'll help better make your work.

Wow, Bizmik... just a bit of overkill there.. Handy information to keep in mind though, I think he just wanted to make sure he could avoid violating any copyright laws Via the (DMCA) Digital Millennium Copyright Act Or (ICL) International Copyright Law - Unknowingly -

Its one thing for someone to commit Infringement / Plagiarism their self & suffer the the consequences. However when an Unknowing Buyer pays for blatant Theft it becomes a whole new issue. Sure the buyer will eventually have all charges dropped if they can prove they didn't know any better. However they still have not only the court costs, Name dragging in the mud, & legal fee's, They are also stripped of the illegal copyright & have to take a loss on the investment.

I think it's a VERY important Topic. I even make sure to place a link back in EVERY GPL/GNU Open Source CMS in the footer (with the Lic.) in the form of a credit link along with advising any client that may be having a theme / template designed & or other modifications of a GNU software.

While this is an important & ongoing Issue, as Adam already stated, their isn't much you can do, besides conduct research on the freelancer / company in question, Hire a local firm in your area whenever possible (Probably the Best solution), & Stay away from offers that sound too good to be true - They normally are!
