There are a ton of old templates out there that are legally sold with resale rights.
If you are planning on reselling them you need to buy them with master resale rights. Otherwise you are the end consumer and allowed to use but not resell them.
Most of the things I acquired that came with resale or master resale rights had an enclosed file stating that. I have had the misfortune to buy a few that did not include that statement.
I always print the page of any site or auction that I buy from figuring that that will be my proof that I am not "intentionally" using someone elses work.
As an end consummer I doubt that you have anything to be concerned about. YMMV.
