I have sent £1200 to someone in this country (UK) by bank transfer (t/t), the person has sent me back £900 but seems to refuse to send me the rest of the money what can i do about this.
the money was for 10 ipod nano 4gb and my supplier says he was scammed by his supplier in Hong Kong so the money he is refunding is out if his own pocket. I have his telephone number and when i speak to him he tells me he is trying to get the money back. The worrying thing was that the other day he told me he was just 16.
Phone him up and tell him the problems he faces with his supplier are nothing to do with you. He owes you money for a product you didn't recieve, and unless you get it all back within 2 weeks you are going to have to take him (or his parents) to a small claims court.
Yeah you can take him to a small claims court for £300.
I doubt a 16 year old kid would have the guts to lie in court, and if he does he better have a pretty good story because the court are going to want to know 1) why he would think it's a gift 2) why he gave back £900 of this £1200 gift.
If you have the reciepts of the payment and all other relivant information you should have no problem getting the money back in court. My guess is though that as soon as he thinks he is going to court you will get your money back pretty sharpish.
Before you talk to him about court get some email corespondence going so you have even more to suuggest he offered a service that was paid for and never supplied.
I'm totally clueless about the UK legal system, but I would think that there would still be records of your transactions and I would hope that you would have some copies emails or letters the two of you sent each other. As long as you have those I'm sure you could make a pretty convincing case. I think you should probably give him some time to try to work it out before you get the courts involved though. If what he's saying is true then he got screwed too.
