Hey everyone. I am making a fansite for the band Daft Punk. I have some material available such as pictures and videos. Now nowhere on the site do I claim they are my own images etc and where possible I credit the copyright owners.

I do not have any of the actual songs available and the videos I am talking of are bootlegs.

Ok, I know this all sounds very illegal. What I am going to ask is not if it is, I know I am stretching it a bit. However what I would like to know is what is the worst that can happen in the form of punishment?

I mean if I had to pay for the 'loss' made by the record company would I be required to pay for every video/image downloaded, or jsut once?

You may want to take a look at DMCA.

You are playing with matches and gasoline at the same time.

You could well be gambling with everthing you own or hope to own in the future.

hmmm, so what would I need to do to make the site legal? only link to the videos rather than host them? And the same for the images?

Is it mainly the video that would cause me the problems?

I have made a change to the system, would this be more acceptable: instead of the downloads (including images, video and audio (not of the songs off cds - just midi files)) being hosted and directly accessed from my server when visitors click on the download link they are taken to a page on another site where the content is available. For example Google Video.

Is that more legal on part?

i would think, considering if you look around there is litterally millions of sites which are tribute or band fan sites etc, with multiple images and videos on you should be fine.

i would think that only if you were intentionally enableing users to download song and videos would it be illegal.

but pictures and videos which arnt like the music videos should be ok.

i mean seriously i belive that the web should be free and that images and things like that (as long as you say their source and copyright etc) should be free to be copied and posted etc anywhere

I agree with StOx. I would try to contact the band manager (just send an email to the contact person). Tell them that you have a fan site for the band and you want to make sure you arent breaking any copyright laws. I dont think you will run into any problems since it is a fan site. They are probably happy for the publicity, but you are better safe than sorry.
