There are websites on the internet who are offering free mp3 downloads, without considering the copyright laws. so there's no problem of having an album in your website for a singer, and that your website is so popular, with knowing that all your files are mp3/RM and other audio files?

is there any further future trouble with the law? or hmm maybe the web hosting company you use will just say no to your website? please share your thoughts and opinions, gladly thanking you in advance.

If you are not paying royalty payments to the artist/record company then you are committing an offense under most countries laws. You could potentially be sued by the copyright holder for the projected value of your downloads so technically if you upload a single song on your server and that song is downloaded 1500 times (the police can request server logs) then you could be sued for 1500*cost of royalities + damages. This could be in the region of millions for large artists.

Many sites of this nature are based in countries that don't have strict IP laws or whos' authorities ignore the issue.

But if you are based in a country like America or in the EU, then this is a very bad idea.

Most hosts won't go down the MP3 road unless the site owner has clear permission to use the MP3s in question, and even then it's a bit iffy as to whether or not hosts will allow it. Downloading MP3s takes bandwidth and resources, and a lot of hosts don't want to give those up.

It's a host-specific question, though. The best thing you can do is to ask the host whether they'd allow it.

This is over simplified. It's true 80 % of the time, but not always.

It's amazing I can remember this from my past, but you can "bootleg" any Grateful Dead recording you could ever want to. No royalties involved, because the band, the artists, the content creators, gave their permission. Security knocked people out for bringing tape recorders to Led Zepplin concerts, and charges weren't filed most of the time.

On that note, you can download Caught in a Hustle by Immortal Technique, free from his web site. You can buy two of his albums there, but he's also freely given permission (in one of his songs no less) for the general public to download his music from the internet and expose people to it, or at least the ideas contained in it. The man owns the label he releases his music through, so he does in fact have rights to his own songs, to be able to give them away.

Most of the time mp3 downloads are illegal if there isn't payment made to the rights holder, which is usually Sony BMG or some other company and NOT The Beatles or Michael Jackson. But not always.

yes exactly i was thinking the same, but lots of website out there are offering RM songs for free.. and that is since ages... check for example http://www.6rb.com/ar/file-30/index.shtml

looks like many songs are out there.. but who is the responsible when such site for example claims to be a portal? it makes big bucks though..

And, yes it is true that a few artists do let their songs be used for free, this is becoming a trend among newer artists simply because they make hardly any money from the music sales. The majority of money artists make is through tours and concerts and so the more people who listen to their music the more people likely to go to their concert. Makes sense really.

But you should always check who owns the IP to a particular song and see if any royalties need to be paid.

There are people in the world who rob banks without considering armed robbery laws. That doesn't mean there's "no problem" robbing banks yourself.

Dag. This is something to stop and scratch your head about.

You know you can go to the library and borrow a book, read the whole thing for free, then take it back and someone else can freeload the book? CDs and DVDs too. Actually publishers love libraries because they're paying customers.

Radio stations put out a different kind of mp3 for free to millions of people. And like JamieLewis said, that's from ad revenue.

Napster is fully legal now. You can download mp3 files to a folder on the web, but when you stop paying for their service, you don't have the files anymore. Kinda like the radio - you can hear a song for free, but you can't choose when. I think both of those have something to do with why they're legal - if you can download an album you're not gonna buy it, but if you hear a good song on the radio and they don't play it again, you might actually buy the CD to hear the rest of it and the one good song again.

The evil RIAA is suing grannies and 7 year olds, so personally I wouldn't risk it.
