F: I would like to say thank you for keeping an eye out. Unfortunately, today, we must "police" because there is alot of plagerism and concept theft which hurts everyone in the industry and clients alike.
Nightvision: Thank you for the kind words. I don't believe you ripped the SEOMinds logo (not mine any longer, it belongs to the company who purchased it from me). And, I don't think F was saying that you did. It was an observation.
The problem arises when simple marks are used: a circle is a circle is a circle.....know what I mean? This happens frequently and it's just a matter of seeing it for what it is and making a choice of moving forward with it or creating something a bit more distinctive. The more complex a logo is, the more unique it is, the easier it is to identify it as theft versus coincidence.
In this case, (nicely done, by the way) I do see how they feel similar but I am sure we can find at least another 50 or so logos that will have the same "feel"......take a look around and you will also see hundreds of "swooshes" and hundreds of "spirals". But they all must have something different which makes them unique or else all these companies would be using the same logomark.
In our situation, there isn't much of a difference other than the swooshes being thicker and transparent between them. Would that be enough to make it different? I really don't know. I see them as the same and different at the same time.......however, my fear would be that these 2 companies could have potential legal issues arising from it.
This is part of the problem with "contests"....nobody does market research (which is time-consuming and costly). Research is done to protect the client as much as possible and ensure to the best of our ability that they receive a unique product. In part, this is one of the reasons agencies charge substantially more.......and rightfully so.
The question here would be does the company/client want to risk it and take the chance of using something that is already in use (or similar) with the possibility of some legal actions in it's future? Hope this helps......
But, we can't even get to that point if the contest holder doesn't come back and provide the feedback that we are all waiting for.
Any chance of this being chased up?
