1) You don't know that they don't have permission to use those images, 2) just because the companies haven't said anything so far doesn't mean they won't in the future (remember when the folks who owned the patent on the compression used in GIF files suddenly decided they wanted their cut?), and 3) your own moral compass, not any threat of punishment, should prevent you from doing what is not legal.
Matt, be careful with online versions of retail games. Unless they have the blessing of the copyright holder of the original game, you may end up in hot water. Generally, creating derivative works (such as an online version of a game) is covered by copyright law, meaning legally only the copyright holder or its assignors can create the derivative work.
