A friend and I have been arguing recently over this discussion, and I thought I should get some 2nd opinions

Let's say you want a software, Photoshop for example. A friend online sends you the software over the internet WITH the serial number. Is it legal? I say yes, since he's giving you serial number, it's just like he handed you the CD. My friend says no however, because you didn't actually buy it.

Either of those scenarios is a violation of the software license acquired by the purchaser. Remember that no one owns the software but Adobe. When you buy the software, you're purchasing a license of use and you are bound to honor that licensing agreement. By transmitting the software or even giving the CD to another person with the serial key, the license is being broken provided the software remains installed on a previous computer.

MOST licenses only allow for one user to install one copy on one computer.

That said, I believe that such licensing agreements are overly restrictive and invade the rights of the consumer (not to mention invading what defines a free individual in a democratic society). But that's my opinion and another topic entirely which you didn't ask about.

Cool Trick that is legal:
Buy a second hand copy of photoshop an old version real cheap, then upgrade to the latest and greatest - you'll be laughing.
