Of course it wouldn't validate. But thats not really the issue.

My feeling is that <video> and <audio> and even <footer> and <nav>
tags would still work in browsers that support HTML5 (e.g. Safari , FFox, Opera).

In fact, strictly speaking I think the DocType is not even a required element other than to distinguish between "quirks" mode and "standard" mode. Pages will still render without one.

Of course its not good practice but the question is would it work?

Should work as long as you're in "standards" mode (assuming the browser supports it)

Why not change the doctype to a HTML5 one anyway? You can use either html or xhtml syntax. Am I missing the point?
