It is not spam, because these people are double opt-in. and if they want to unsubscribe, they can do so.
However, I learned last week that even double opt-in is not the ultimate protection 100%!
If one of your subscriber forget that he subscribedto your list, he can report you as SPAM.
But if that happen, you will be fine because you have a record in your responder software, that this subscriber is double opt-in!
The only problem in this case would be your autoresponder or webhost. If it is not a good one, they can shut down your site without notice.
For that, you can add at the beginning or at the end of all your email (easily do that in your admin panel).
