Well with all this talk about coming down hard on marketers on myspace how do you think myspace will come about it C&D letters or will they just start suing?? Any opinions

I think in any situation you have to get a C&D first warning you that you are outside of the TOS. Then if you don't act accordingly then they are able to take it to a higher autority.

I don't think they will really sue anyone but the people that make the programs. There are thousands of people doing this and they don't have the capacity to start sueing all these people. Not to mention they don't know what and if people benefited off these programs. Some guys make $0 some makes $1,000/day. They can't just point fingers and demand money people didn't make.

Just my two cents.

I agree and disagree :blink:
I agree that they probably won't sue the thousands if not hundreds of thousands of people who spam or market. However, the record industry went after some pretty small fish and won cases so you never know.

Secondly, I would think they'd go after people they have a pretty good idea made serious money but I'm pretty sure they can sue anyone, subpeona banking records, find out if folks made money or not. It seems unlikely though.

yeah, i wouldn't be surprised if they took a select handful to sue
just to scare off the masses.

I'd assume they would target those pushing the products that appear
sketchy.

They are going after the software vendors and the CPA companies.

As long as you don't phish or send out too many messages you will be ok.

they might or might not sue you without any warning, no one knows for sure. shouldn't come here for legal advices. weren't you the one on the warrior forum like a month ago warning everyone to stay away from myspace LOL. maybe you should take your own advice?

The RIAA situation is different though. Downloading music for all intents and purposes is illegal. Spamming myspace is not. Yes it's against their TOS but it's not illegal. They try to throw the Can-Spam act around but I don't think it has any weight. This isn't email and people basically 'opt in' when they add you as a friend. And myspace could easily end all of the spam if they coded their site better. It would not be that difficult.

The phishing and the promotion of porn is another deal entirely. And the people that do that deserve to be sued or whatever.

Yeah - to be honest, I think the phishing, porn promotions, and stopping the perverts looking for an underage girlfriend is their biggest concern.

So as far as I am reading, occasional bulletins with links and update information about my site is ok? I do not comment spam, send any automated private messages, or phish accounts or anything fishy. I just use some adding programs and some trains and such to keep my account at about 2k and get some people to my myspace sites.

Is this ok?

I think most of this talk of people being sued is pure internet trash. It's like when I was a kid, you saw a phone number of some girl in a bathroom for "a good time" so it must be true.
Seriously, I cannot possibly imagine how what you are describing could possibly be considered as spam.

Nice analogy mike and thanks for your advice. My content isn't even remotely adult in fact there is very little right now and none of which has a picture of any human so content should be fine.

As long as you didnt go overboard with the spam (requests, comments, and messages), and as long as you didnt phish or promote any corrupt products and/or websites...... youll be okay.

I'm sure 95% of people will not be sued. I've only heard rumors about actual individuals getting sued. I hear much more about mass spammers, and a few cpa networks being in question.

So don't sweat it. Making regular bulletins posts about site updates, new content, etc is perfectly legal, within certain standards.. (as long as your account is legit, not phished, not stolen, etc..)
