Affiliates and the new tobacco law

The tobacco niche has been a very lucrative part of the affiliate marketing field for several years now. With cigarette prices increasing everywhere, smokers are constantly looking for cheaper options on the internet, and they tend to be repeat customers that lead to ongoing commissions.
The PACT act goes in to effect in a few weeks, and it will greatly restrict mail order cigarette sales within the United States. What effect will this have on the tobacco affiliate niche?

My company has been operating in this area for a few years and since we're not based in the US, we hope that these new restrictions will not effect us.

Will American based tobacco sites with established traffic and client bases be interested in an affiliation program?

The tobacco niche is very profitable and people that buy cigarettes online tend to be repeat customers. This gives affiliates the opportunity to make ongoing commissions for customers that they refer.
This new law, that goes into effect very soon, is going to greatly effect the sale of tobacco products online for companies that are based in the US.
Prices will almost certainly rise, and companies that are based outside the US will be more flexible.
What effect will this have on the tobacco affiliate market?

The PACT law is going to go into effect very soon and it is going to drastically impact the way tobacco is sold online. The law places new limitations on shipping tobacco products.

I'm curious to hear people's thoughts about how this law will effect the sites that work in the tobacco niche. My company is based outside the US and we plan on continuing to sell and ship cigarettes to the US after this law goes into effect. Will American based websites be more willing to enter into affiliate partnerships now?
It seems to me, that this law is going to create a vacuum and there will be a lot of potential for people with experience in this field to make money within an affiliate program.

The states are very sensitive to any loss of tax revenue.......
Many take a strong stance ....once any object or product falls into the contraband or tax evasion category the laws become much stronger....and enforcement is actually easier....

As a smoker, I would hate to spend a couple of hundred bucks and have some agency grab my cigs.....

A couple of cases that make the news channels and "el crasho" to the mail in business...

That's a very good point about orders that never make it. Unfortunately, there are countries that make it more difficult to ship tobacco products to and we are unable to operate there as a result of that, but we have not had this problem in the States. In the event that a customer doesn't receive their order, we give them a full refund, and the affiliate still gets paid the commission.

Affiliates earn 20% on tobacco on both initial purchases and repeat customers
