If we said that WalMart spams, it would be a statement that no one would believe. But, we get numerous emails from some email marketing agencies offering free walmart coupons for something or the other.

Is this not spamming? I think it is because walmart could hire thousands of these small email marketing guys to spam us all the while.

Just wondering.

You're correct in that it is spam.

Where you're incorrect is assuming that Wal-Mart is directly responsible. Usually, Wal-Mart finds some third-party marketing firm, says "Get XXX number of our coupons out", and the third-party marketing firm takes over from there.

In the case of the online marketing firms, they quite often UCE those coupons out and we get the spam situation you're talking about now.

Ultimately, Wal-Mart needs to take some responsibility in checking out these firms and making sure they're above board, but the real responsibility comes from the firms themselves.

Good question, though.

But this is one of the rare examples where "vicarious liability" makes sense. Google uses the same principle; if you hire a shady seo firm that makes dishonest changes to your site, you pay the price. It's not like the world's largest retailer can't afford a little due diligence.

Forrest: hence the word "directly". There's no question that Wal-Mart should be held accountable for their choice, but ultimately the people who are the most responsible are the ones spamming the coupons.

I don't think there's an exact, precise meaning for the word spam. You could ask ten different people, and they'll all agree on the gist of it, but if you press for details, you'll get ten slightly different versions of what is and isn't spam.

Say I know a friend of mine has been drooling after a bigger hard drive for months, and I get one of those emails from Tiger Direct that happens to have a great deal on a hard drive. Naturally I'm going to forward the message on to my friend and let him decide if he's interested, because he's been talking about how bad he needs a drive. Is that spam? It's an unsolicited commerical forward, but from a friend with personal knowledge of the situation.

What if I hear about a job and give them a friend's email address who's extremely unhappy at his current job, and this is something he's more into? ( It's an IT job at a organic food company, and he's a hippie vegetarian. ) If they write him because they've been told he would enjoy working there and has brilliant developer skills, is it spam? The two of them have no prior relationship, that's why I'm playing match maker.

( FYI, I cleared it with him first, but if I hadn't, it's a good example question. )
