How do large file upload hosts manage the legality of copyright violation regarding music, images, etc.?

How far can this get you into trouble?

As long has you have very clear disclamers, you should be okay, providing you remove all known violations or any reported violations.

As Lpspider said, it's all about the disclaimers which is how most of the 'big boys' are staying away from legal action. As well as this, most of them are very happy to remove any files if requested and do so in a prompt manner.

I'm thinking of starting an upload site up myself, just bought the domain FreeUpload.eu, see what comes of it.

Ok for me, I'll say what I know, since our site is considered "huge."

FasterUpload.com ALLOWS images, videos, and content, but here's what our TOS says:

You agree to not use FasterUpload.com 's Service to:
upload, post, email, transmit or otherwise make available any Content that infringes any patent, trademark, trade secret, copyright or other proprietary rights of any party; FasterUpload.com 's DMCA Policy has more details;

Ok so we have a few admins, who look at every file uploaded. If there are none available, we run scripts/spiders that look for any files that could be a threat.

In fact, half of what's uploaded to our server is warez, and the file names are easy to recognize if they are warez or not.

The best way to go is hire people to help you. If not, find a script that can spider your database.

I think one thing that you mentioned is a good idea is to have a report file type of deal so the community can help you out a bit too

I was going to open one myself and actually did but then I couldnt find the time nor a proper way to advertise it so I decided to sell it on Site Point (before it started making those stupid changes).

Ya it shouldnt be too hard all they would have to do is send an email when the button is clicked that includes the uploaders IP (if possible), link to file and delete link.

Welll I use XtraFile, my own script. I could port something similar from FlatFileHost which allows 1 click reporting.
However I need a form that descrives why they're reporting it.

Same here. we do the same... but once you have a file host with 2,000+ files uploaded in 5 hours you get tired.

When you get a website that becomes really popular you should consider hiring someone maybe even just part time to do parts of it for you.

I started hostfilez.com which is now sold, but anyway, I used to get a few emails from companies asking me to remove files, and then I removed them, no problems.
It would be impossible to check every file uploaded. I plan on starting another site, using xtrafile.
