rapidshare itself is legal... but a lot of the content on it is not.

I'm pretty sure they have a disclaimer saying that users shouldn't upload illegal stuff, that keeps them off the hook--- at least for now.

In Germany. Also, they are very good to remove illegal content if you have the link...unfortunately I put lots of requests in for that very service

Rapid share is a legal site like download.com, megaupload.com and many other sites, but the content they host is illegal, this is because they dont check the file uploaded

Right, as long as they force all users to agree not to upload illegal content and remove illegal content when they find it...then Rapidshare should not get in any trouble - as they cannot control what their users do...but if they start to say it's ok to upload this and that...or dont remove illegal content when they find it or when it's reported, then they could get in trouble...but other than that, I'd imagine they're ok - but thats my unauthorized opinion

It's a free upload site. i don't think it is illegal to have a file hosting website. Just look at MegaUpload.com.

Even if its a uplaod site it should review the uploaded file first before giving it for downloading!

Yes .. warez sometimes stay for month and sometimes are not removed ..

They are legal but I've found that they are very quick to removing content that's not (once reported).

Yeah, I know quite a lot of popular album sites have lots and lots of albums there. Some of them lost hundreds of albums that were hosted at RapidShare when they removed them.

So yeah, they're on their toes when it comes to illegal content.

They can't be expected to manually check every file that is uploaded. Rapidshare itself is legal, the files uploaded usually aren't :P

lol anyway many uploaders are changing file names ... for example they change Mission Impossible III.part1.rar to Xyz.part1.rar so that rapidshare will harder know if they were warez or not ...

That is why they use that user report thing. It is a good thing because people who know that link can report it if they do not want it there, ie. warez.

would that keep them safe if they were in the United States?
