Okay, I got a call from a potential client who wants a website. The website will augment his offline business, and will be e-commerce related, but as much as I searched I couldn't find a decent solution for him to save my life.
So I thought, if he was willing to pay for the development (at my cost) and I keep the rights then I could have an awesome product on my hands that I could sell over and over again!!
He seemed interested so I started looking for domain names and found a winner!. It's short, simple and to the point. Here's the catch...
The .com of the name is taken. Was registered 1 year ago for 2 years but has not been used. It's just a GoDaddy splash page. The owner, however, (looked in whois) is a web application developer and has done projects similar to this in the past.
Now, the .net is available and the name (which is pretty good IMHO) is not trademarked or used.
I was thinking I could register the .net and design a logo, develop a rough beta and trademark the name/logo. If I owned the trademark on the name, he wouldn't be able to use it in the same industry (E-commerce).
Then I could contact him about purchasing the .com name for a reasonable amount.
I am afraid of just going to them and asking to purchase the name, because they might file a trademar, use the name, or demand a large amount of money.
Thoughts?
Should I try to use the .net and trademark it so I own the rights to the name (to protect the brand) or just pick another name alltogether??
