Simple as it may be Im struggling to work out if what I have setup is acceptable as a sitemap, my menu is constructed on the fly from php and I have linked to this as a sitemap, google doesn't like it as when I submitted it to google it threw me an error, does this mean its no good as a sitemap?

It is just no good as an XML sitemap because it isn't XML,

So it doesn't get submitted to Google, it doesn't get referenced in the robots.txt it simply gets linked on the site pages so that crawlers can find it.

All
search engines can use a HTML sitemap AND it WILL help with ranking because of the anchor text. Unlike a XML map which may only help with "URL discovery"
