I'd say any idiot can throw up on their scanner and create the paint splotches effect in your header and his. It would only take a minute in Photoshop to convert it to greyscale from there.

I'd say someone was influenced by someone else. I wouldn't call either site a copy of the other, because the only two similarities are the header and color scheme. As far as "who influenced who" or "who copied who" goes, either one of you could have stolen from the other guy, so I'm not touching that.

I dunno, it looks like a pretty obvious copy job, with some changes in it to look slightly different, even the background is very similar.

I wouldn't say it's a copy. There are some similarities for sure, but neither site is exceptionally unique that would make that odd.....

I've been in this sort of situation many a time in the 6 years I've been freelancing. If anything, I treat it as a compliment. That's to say, my designs are of a good enough standard to be ripped.

You should really hear two sides of the story before answering, or even posing this question in fact.

I used the navigation style from http://stage6.com but changed the hover colour to the colour which is the same as the logo.

The background is not even mine, it was suggested to me by a friend who found a pattern on google images. I added gradient to it, which I got the idea of gradient from http://veoh.com

As for the logo. I browsed around google for inspiration. And found this website which designs logos, websites etc.

http://inkstaindesign.com/

I thought for a minute and decided to use their name (inkstain) as my logo. Then I downloaded a plugin for photoshop with a brush which does ink blobs.

The colour scheme of the whole website is found on thousands of websites. White, on a shaded effect. Hence the flowers.

Hey maybe the guy didn't copy - I have seen several sites quite similar to this before. There are a lot of similarities though - there's nothing wrong with using sites for inspiration but you should really create something unique when you design a site.

I don't mean to sound harsh or add to the coming flame war, but you are being totally unreasonable. Without sounding like a complete ***, there is absolutely nothing "original" about your site. Let's take a look:
-Dark gray textured background
-Black navigation menu with white text
-White body with black text for main content
-Rotating images of portfolio

Well.... that about sums up both your site, and 343249320 other web developers portfolio sites. The only thing that comes close to being suspicious is the logo, which he has given a VERY plausible explanation too...

To sum it up, your site isn't original, and because of that it will look like other people's sites. If you make a thread about it, it just makes you look like an ***..... Sorry if the truth hurts, but this is a completely unbiased opinion, as I've never heard of either of you before coming to this forum.

It's not a copy IMO, just a similar style. These things come and go. There is hardly that many designers out there that aren't influenced by the design of others. I would expect other sites out there to look like mine, and I would compare them to see where mine could have been better. A good web designer is more than a graphic artist.
