Hello,

How do webmaster's write the site site's terms and conditions? I heard you need to get a lawyer to do it properly but that will cost a lot for just a simple terms and conditions.

What other ways to people do it?

You don't need a lawyer.

Just write out what you allow, what you don't allow. and update it when new issues arise.

You do need a lawyer if you want to be covered as much as possible. You don't want any loopholes that people could exploit. You just jotting down what you allow and disallow will not hold up in court very well.


Or, you could find a similar sites and "borrow" some of their wording and throw in some of your own.

A lawyer is going to be necessary to really cover yourself. I used the borrowing technique. I looked over the terms of 3 or 4 well known web hosts and spent a couple of days reading through and rewriting what they had to come up with my own. I do intend to have a lawyer look over what I have at some point though.

Really though to cover yourself you only have to make sure it's clear that if anything goes wrong while the person is using the site, you are not to blame and that you can change the terms at any time without warning.

Unless of course you are selling a product, which would mean your terms are worthless and you are bound by law.

Really, it completely depends on what service you're running. For example, web-hosts or ad service providers should always have disclaimers, TOSs, AUPs and privacy policies.

Information sites may just have/need a privacy policy and simple disclaimer.

I would look at the Terms and Conditions from other sites, and word yours based on that.
Remember to use passive language (i.e. not "you agree not to sue us if something goes wrong", but "the visitor agrees to hold the site harmless in the event that a problem occurs").
Also, when in doubt, say more rather than less. Make sure to cover yourself for anything you can think of, from a hacker attack to an act of God. Few people read the fine print, but what you put in there could save you in court if something really out of the ordinary happens.

Good Points, you could maybe find a lawyer 'friend' that will do this for free, lol

I personally did that, but now I removed the TOS, because I felt no need for them,

i mean, how could somebody sue me if i run a template site, what a template made their pc blow up.

but yeah im reckless i should put up a TOS
