First of all, no one's a spammer these days. Everyone believes they're on the up and up, and most people aren't. I'm not saying that you're not or you are...I'm just saying that you're using the same party line that a lot of spammers use.
The question becomes: what is your email policy (that's usually the reason people get hosting accounts suspended)? Do you send out mass emails? Is it an opt-in (ideally, a double opt-in) list? If you can establish these things, then you should be okay.
In other words, you need to lay out, in detail, the information you gather on people, how you gather it, and what you do with it.
